Privy Council delivers Judgment

Taitt v Trinidad and Tobago [2012] UKPC 38; [2012] 1 W.L.R. 3730

The Privy Council delivered its Judgment granting the Appellant permission to appeal his death sentence. There was evidence that the Appellant was mentally impaired. The Privy Council remitted the appeal to the Court of Appeal in Trinidad and Tobago to consider whether the death sentence, when passed against a person who is mentally impaired, is cruel and unusual punishment contrary to the Constitution.

The Appellant was represented by James Guthrie QC and Clara Johnson. The Respondent was represented by Tom Poole.
