Constitutional Reform - legality

05 December 2008

James Dingemans QC represented the appellants in a case before the Court of Appeal which raised issues of the legality of constitutional reforms of the Channel Island of Sark. It was held that it was inconsistent with the European Convention on Human Rights, article 6, for the Seneschal to be the principal judicial officer of Sark and to be linked with the executive and legislature in the manner and to the extent that he was.
